Senate Majority Leader Bill Frist (R-TN) threatens to invoke what Republicans have called the "nuclear option" - an unprecedented power-grab that would break a more than 200 year-old Senate rule that has, until now, protected the rights of the minority by allowing the filibuster of unqualified, out-of-the-mainstream judicial nominees.

Take the case of Janice Rogers Brown. Brown holds a right-wing ideological judicial record that has consistently attacked the stability of LGBT families. In 2003, Brown was the only justice on the California Supreme Court to rule against recognizing the right of LGBT Californians to legally adopt their children. Brown argued that allowing a gay parent to legally adopt the biological child of their partner "trivializes family bonds."

Brown was rejected by the United States Senate in 2003, and rated "not qualified" by the California Judicial Nominations Evaluation Commission - twice. But Bush and Frist want to promote her - and six other extremists - anyway, and are willing to trample on the rights of the minority party in Congress to do so! If they change this rule now, what is to stop them from terminating other minority rights in the Senate or using a slim majority to ram through other controversial measures - or a Supreme Court nominee?
